The Complaints

The complaints in this case arose after the applicant’s stepdaughter was arrested.

We have reviewed the handling of six complaints, namely that: 

  1. On 27 February 2024, officers did not carry out CCTV enquiries following a report of assault made by the applicant’s stepdaughter.

  2. On the same date, officers did not provide the applicant’s stepdaughter with medical assistance when it was requested.

  3. On the same date, an officer applied handcuffs too tightly to the applicant’s stepdaughter, using excessive force. 

  4. On the same date, officers handed keys belonging to the applicant’s stepdaughter to another person. 

  5. On the same date, within a police vehicle, an officer was rude to the applicant’s stepdaughter when she stated she would have to clean up the mess caused by a bleeding facial injury. 

  6. On 28 February 2024, an officer did not assist the applicant in a request to retrieve the keys belonging to his stepdaughter.

Police Scotland's Decision

Police Scotland did not uphold any of the applicant’s complaints.

Our Findings

We have found that Police Scotland handled complaint 3 to a reasonable standard, but not so complaints 1, 2, 4, 5 and 6. 

Consequently, we have made four recommendations to address the shortcomings in Police Scotland’s handling of the complaints. In summary, we have recommended that Police Scotland conduct any further necessary enquiries, re-assess the available information in light of our observations and, thereafter, provide the applicant with a well-reasoned further response which clearly explains whether the complaints are upheld or not upheld. 

Our recommendations should be implemented by Police Scotland within two months of the date of this report.
