The Complaints
The complaints in this case arose after the applicant was arrested and held in police custody.
We have reviewed the handling of two complaints, namely that:
- between 28 November and 2 December 2024, at [Named Police Station], the applicant was stripped of his clothing and left naked in his cell; and
- between the same dates and at the same location, a female officer checked on the applicant in his cell on two occasions, in the knowledge that he was naked.
Police Scotland’s Decision
Police Scotland did not uphold either of the applicant’s complaints.
Our Findings
We have found that Police Scotland did not handle either of the applicant’s complaints to a reasonable standard.
Consequently, we have made two recommendations and identified one learning point to address the shortcomings in Police Scotland’s handling of the complaints.
In summary, we have recommended that Police Scotland conduct further necessary enquiries and re-assess the material information in light of our observations.
Thereafter, Police Scotland should issue the applicant with a well-reasoned further response which clearly explains whether the complaints are upheld or not upheld. Our learning point relates to the quality assurance process.
Our recommendations and the learning point should be implemented by Police Scotland within two months of the date of this report.
