The Complaints

The complaint in this case arose after Police Scotland issued bail conditions to the applicant’s ex-husband, which disclosed her current address. The applicant is separated from her ex-husband, who was previously abusive towards her and two of her children. In 2025, a police investigation commenced into the abuse allegations which resulted in the applicant’s ex-husband being arrested for two counts of assault. The applicant’s ex-husband was released on undertaking with specific bail conditions not to approach the children, and not to enter into the street where they reside. We have reviewed the handling of one complaint, namely that:

  • Police Scotland disclosed the street where the applicant resides to her ex-husband when he was given bail conditions, which put the applicant at significant risk.

Police Scotland's Decision

Police Scotland did not uphold the applicant’s complaint.

Our Findings

We have found that Police Scotland did not handle the applicant’s complaint to a reasonable standard.

Consequently, we have made a recommendation to address the shortcomings in Police Scotland’s handling of the complaint. In summary, we have recommended that Police Scotland conducts further enquiries into the applicant’s complaint and provides a further well-reasoned response.

We have also identified a learning point relative to Police Scotland’s administration of the complaint.

Our recommendation and learning point should be implemented by Police Scotland within two months of the date of this report.
