The Complaints

The complaints in this case arose after the applicant reported the alleged actions of three police motorcyclists on a motorway.

We have reviewed the handling of one complaint, namely that: 

  • Three police motorcyclists drove in a dangerous manner by pulling sharply in front of the applicant’s vehicle, causing him to brake.

Police Scotland's Decision

Police Scotland did not uphold the applicant’s complaint. 

Our Findings

We have found that Police Scotland did not handle the applicant’s complaint to a reasonable standard.

We have not made any recommendation to Police Scotland in respect of the shortcomings we identified in the handling of the complaint. We have however identified a learning point about the administration of the complaint with regard to record the rationale for all decisions made.

Outcome

Police Scotland implemented the learning point in this case that related to maintaining good record-keeping in order to be able to demonstrate that complaints have been dealt with diligently and based on the available evidence. Police Scotland confirmed that the learning point was disseminated to the relevant officer who acknowledged the learning.
