The Complaints

The complaint in this case arose after Police Scotland received a report that the applicant’s ex-partner was in attendance at her address and causing a disturbance. Officers attended the applicant’s address and ascertained that her ex-partner was not present at that time. We have reviewed the handling of three complaints, namely that: 

  1. On 7 January 2024, a male officer pushed the applicant and entered her address while she was holding her young child, 

  2. On the same date, a male officer acted in an aggressive manner and shouted something similar to “We’re coming in to see if he is fucking here”, and

  3. On the same date, officers forced their way into the applicant’s house without requesting permission or having lawful authority to do so.

Police Scotland did not uphold any of the applicant’s complaints. 

Our Findings

We have found that Police Scotland handled all of the complaints to a reasonable 

However, we have made three recommendations to address administrative shortcomings in Police Scotland’s overall handling of the complaints. In summary, in relation to complaints 2 and 3, we have recommended that Police Scotland re-categorise the complaints. In relation to complaint 3, we have also recommended that Police Scotland amend the determination recorded. 

Our recommendations should be implemented by Police Scotland within two months of the date of this report.
