The Complaints
The complaints in this case arose after the police issued the applicant with a fixed penalty notice for driving through a red light. Whilst interacting with the applicant, officers suspected that he was under the influence of drugs and asked the applicant to provide a saliva specimen for a roadside drugs test, in accordance with Section 6C Road Traffic Act 1988. The applicant refused and was thereafter arrested and conveyed to the police station where he provided a blood sample for analysis. We have reviewed the handling of six complaints, namely that:
On 5 March 2024, an officer unlawfully arrested the applicant by demonstrating bias, as he said, “I don’t like the look of you”.
In March 2024, there was no assessment carried out on the applicant’s fitness to be detained.
Officers failed to accommodate the applicant’s ADHD, despite him stating numerous times that he had ADHD and did not understand what was happening.
Officers failed to notice and report an error in custody procedures.
Between 5 March 2024 and 5 March 2025, officers failed to provide the toxicology report to the applicant’s lawyer or the court, and
The applicant’s case was elongated without justification.

Police Scotland did not uphold the applicant’s complaints.
Our Findings
We have found that Police Scotland handled complaints 1, 2, 3, 4 to a reasonable standard but not so complaints 5 and 6.
