The Complaint
The complaint in this case arose after the applicant contacted Police Scotland to report what he believed to be crimes of misconduct in public office and conspiracy on the part of named organisations. We have reviewed the handling of a single complaint, namely that:
1. Police Scotland made false statements to the applicant, by informing him that his report about the conduct of the Scottish Legal Complaints Commission and the Ethical Standards Commissioner were reported to the Procurator Fiscal, when it had not been.
Police Scotland's Decision
Police Scotland did not uphold the applicant’s complaint.
Our Findings
We have found that Police Scotland did not handle the applicant’s complaint to a reasonable standard.
Consequently, we have made a recommendation to address the shortcomings in Police Scotland’s handling of the complaint. In summary, we have recommended that Police Scotland conduct further necessary and proportionate enquiries and provide the applicant with a well-reasoned further response.
Our recommendation should be implemented by Police Scotland within two months of the date of this report.
