The Complaint
The complaint in this case arose after the applicant raised concern with Police Scotland about the death of his brother, a vulnerable adult, while he was under the guardianship of a local authority. We have reviewed the handling of a single complaint, namely that:
Police Scotland did not investigate the applicant’s brother’s death.

Our Findings
We have found that Police Scotland did not handle the applicant’s complaint to a reasonable standard.
Consequently, we have made a recommendation and identified a learning point to address the shortcomings in Police Scotland’s handling of the complaint. In summary, we have recommended that Police Scotland conduct any further necessary and proportionate enquiries and thereafter provide the applicant with a further well-reasoned response to his complaint.
Our learning point is a reminder of the appropriate use of Frontline Resolution and of the circumstances where it may not be necessary or proportionate to progress a complaint through the full six-stage process.
Our recommendation and learning point should be implemented by Police Scotland within two months of the date of this report.
